Fair Labour Mobility must strengthen rights, not deregulate!

EFBWW warns that the upcoming Fair Labour Mobility Package must focus on improving working conditions and strengthening enforcement, rather than promoting deregulation.

The EFBWW notes that the European Commission correctly identifies the key challenges, including long subcontracting chains in high-risk sectors, the growing number of posted third-country nationals, and persistent enforcement gaps. In sectors such as construction, experience shows that fair labour mobility cannot be ensured through voluntary measures or administrative simplification alone.

According to the EFBWW, clear rules, effective liability regimes and credible enforcement are essential to prevent abuse, protect mobile workers and ensure that labour mobility contributes to social cohesion instead of undermining it.

The EFBWW therefore calls on the Commission to ensure that the forthcoming proposals improve job quality by promoting direct employment relationships, strengthen enforcement mechanisms, protect workers and restore fair competition. From the EFBWW’s perspective, the most effective way to achieve these objectives is through a binding legislative initiative that limits subcontracting to a maximum of two tiers, supported by mandatory joint and several liability throughout the entire subcontracting chain.
